Machinery Safety

Sobald eine Maschine im Europäischen Wirtschaftsraum erstmalig in Verkehr gebracht wird, oder bei einem Umbau eine wesentliche Veränderung vorliegt, sodass praktisch eine „neue“ Maschine entsteht. Rechtsgrundlagen sind u. a. die Maschinenrichtlinie 2006/42/EG bzw. ab 20.01.2027 die EU‑Maschinenverordnung 2023/1230 sowie das nationale Produktsicherheitsgesetz.
Wichtig: eine CE-Kennzeichnung darf nur erfolgen, wenn die Maschine oder das Produkt unter eine entsprechende europäische Richtlinie oder Verordnung fällt. Eine CE-Kennzeichnung “auf Verdacht”, ohne rechtliche Grundlage, ist rechtswidrig und somit strafbar!
Rechtlich verantwortlich ist immer der Hersteller bzw. derjenige, der das Produkt unter eigenem Namen in Verkehr bringt. Laut EU‑Recht muss der Hersteller alle relevanten Anforderungen identifizieren, die Konformität bewerten, technische Dokumentation erstellen und die EU‑Konformitätserklärung unterzeichnen. Nein. Es gibt keine zentrale EU‑Behörde, die CE‑Zertifikate ausstellt. In vielen Fällen führen Hersteller die Konformitätsbewertung selbst durch. Nur für bestimmte risikoreiche Produkte ist eine notifizierte Stelle als unabhängiger Dritter vorgeschrieben. European Union
